Construction Fencing Requirements
The purpose of this by-law is to enhance public safety, protect property, and maintain orderly construction by requiring secure, uniform fencing around construction and demolition sites, consistent with the City's authority under the Building Code Act and the Municipal Act.
- Fencing must be:
- Of uniform material and constructed from smooth exterior-grade plywood
- Solid, painted, or vinyl-wrapped
- Height: 1.8m to 2.0m (5’11”–6’6”)
- Thickness: Minimum 12.5mm (½”)
- Compliant with Ministry of Labour and Occupational Health and Safety (OHSA) standards
- Mandatory for:
- Active/incomplete construction
- Demolition sites
- Fire-damaged buildings
- Hazardous areas or public gathering spots
Scope & Applicability
- Applies only to sites with an active building permit. Sites without a permit or with a revoked permit will fall under the Property Standards By-law instead.
Art & Signage
- Murals and art are allowed with prior City approval
- Contractor branding or signage permitted if compliant with Sign By-law
- Fencing must be kept free from graffiti
Post-Construction
- Fencing must be removed within 20 days after project completion, or may be modified to meet the Fences and Swimming Pool Enclosures By-law
Exemptions
- Not required for:
- Detached, semi-detached, duplex, triplex, fourplex, townhouses
- Residential accessory buildings
- Agricultural, Green Space, Employment Zones
- City-led construction/infrastructure work
- City may waive/modify fencing if suitable alternatives exist, such as existing walls or fences are already available or in place, or for locations and projects where such fencing would not be warranted
Decorative/Informative Fencing
- City to provide info handout on grants and contacts for public art
Enforcement
- Managed by By-law Enforcement Division
- Non-compliance may result in:
- Orders to comply
- Penalties under Municipal Act, Provincial Offences Act, or AMPS By-law
Public Property Guidelines
- By-law serves as a guideline for fencing that encroaches on public property and municipal right-of-way
- Requires separate agreement (e.g., licensing or road occupancy permit) with City
