
Purpose and Effect
The purpose of By-law 2026-055 is to amend Zoning By-law 2013-283 to permit three-storey residential addition on top of the existing commercial building.
The effect of By-law 2026-055 is rezoning 579 Ontario Street from Low Density Residential – Suburban Neighbourhood (R1) to Medium Density Residential (R3) with a Special Provision 196. The Special Provision is proposed to address reduced building setbacks, parking spaces, landscape buffers, and landscaped open space, as well as an increase in residential density and would include additional permitted commercial uses: retail store, restaurant, service commercial, and offices.
By-law No. 2026-055 conforms to the intent and purpose of the Garden City Plan and the Niagara Official Plan.
All written and oral submissions related to the application that were made to the Council before its decision have been taken into consideration by Council as part of its deliberation and final decision.
Legal Notice
The last day for filing a notice of appeal is May 28, 2026, at 4:30pm. The notice of appeal must be filed with the Clerk of the City of St Catharines. It must set out the reasons for the appeal and must be accompanied by the fee required by the Ontario Land Tribunal. The decision of council is final if a notice of appeal is not received on or before the last day for filing a notice of appeal.
With Bill 185 receiving Royal Assent, only the registered owner of the land to which the by-law would apply, specified persons and public bodies as defined in the Planning Act may appeal a decision of the municipality or by-law to the Ontario Land Tribunal.
No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.
