Proposal
The Planning and Building Services Department received an application for a Zoning By-law amendment for lands located at 148 Niagara Street. The Application is to rezone the lands to permit a nine-storey apartment building with 197 units. The application was deemed complete by the City on October 16th, 2024.
The original submission was for a seven-storey mixed use building with 192 dwelling units and 197 parking spaces. A revised application has been received that proposes a nine-storey mixed use apartment building with 197 apartment units, and 201 parking spaces located with a three-level parking structure.
The City’s Official Plan designates the subject lands Mixed Use on Schedule D1 and further designates the lands as Mixed Use on Schedule E5.
The City’s Zoning By-Law currently zones the subject land as Medium Density Mixed Use (M1). To facilitate the proposal, the Applicant is requesting to rezone the subject lands to High Density Mixed Use with Special Provisions (M3-178). The requested Special Provisions request to increase the maximum permitted lot area, lot frontage, and reduce the minimum permitted front and rear yard setbacks.

Email submissions may also be made by noon the day of the public meeting and directed to clerks@stcatharines.ca. Both oral and written comments and recommendations received will be taken into account by City Council in making a decision on the subject matter.
Legal Notice
Only the registered owner of the land to which the by-law would apply, the applicant, the Minister, specified persons, and public bodies as defined in the Planning Act may appeal a decision of the municipality or by-law to the Ontario Land Tribunal.
If a specified person or public body would otherwise have an ability to appeal the decision of Council of the City of St. Catharines to the Ontario Land Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to Council of the City of St Catharines before the by-law is passed, the specified person or public body is not entitled to appeal the decision.
If a specified person or public body does not make oral submissions at a public meeting, or make written submissions to Council of the City of St. Catharines before the by-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.
