Applications for Consent and Minor Variances have been received from Deborah Franko and Rodney Franko for the property at 41 Emmett Road and will be heard by the Committee of Adjustment for the City of St. Catharines on November 12, 2025 at 5:00 p.m.
Application B-23/25SC is made for consent to a partial discharge and for consent to sever 848.7 square metres. (Part 1 on the submitted sketch) to be known as 41A Emmett Street for a proposed duplex dwelling. A 1,697.9 square metres remnant parcel (Part 2) is to be retained with the existing detached dwelling will be retained for continued residential use. Part 3 is to be dedicated to the City for a road widening. There are concurrent minor variance applications A-60/25 & A-61/25.
Application A-60/25 seeks relief from the City of St Catharines Zoning By-law 2013-283, as amended, for the following variance for a proposed duplex dwelling (Part 1):
1. An increase of the maximum lot area for a duplex dwelling from 700 square metres to 848.07 square metres.
2.An increase in the permitted width of the driveway from 50% of the lot width to 55.62% of the lot width (being 5.94 meters wide).
3. Permission for the attached garage to protrude 0.28 metres beyond the corresponding wall of the dwelling unit.
Application A-61/25 seeks relief from the City of St Catharines Zoning By-law 2013-283, as amended, for the following variance for the existing detached dwelling (Part 2):
1.An increase of the maximum lot area for a detached dwelling from 370 square metres to1,697.9 square metres.
