Purpose and Effect
By-law 2025-111 has the purpose of amending the City’s Zoning By-law to facilitate the development of a five-storey apartment building with 30 apartment units and 32 parking spaces.
By-law 2025-111 has the effect of amending the zoning of 97 Hartzel Road to add Special Provision 186 to the existing Medium Density Mixed Use (M1-186) zone. This allows for site specific metrics to facilitate the proposed five storey apartment building.
By-law No. 2025-111 conforms to the intent and purpose of the Garden City Plan and the Niagara Official Plan.
All written and oral submissions related to the application that were made at the public meeting have been taken into consideration by Council as part of its deliberation and final decision.
Legal Notice
The last day for filing a notice of appeal is September 30th, 2025, at 4:30pm. The notice of appeal must be filed with the Clerk or submitted through the Ontario Land Tribunal’s (OLT) e-file portal. It must set out the reasons for the appeal and be accompanied by the fee required by the OLT. More information on fees can be found on the OLT’s website: https://olt.gov.on.ca/fee-chart/
