The Planning and Building Services Department received an application for a Zoning By-law Amendment for lands located at 583 Welland Avenue. The application was deemed complete on January 7th, 2025, pursuant to Section 34 (10.4) of the Planning Act. Revised materials were submitted on June 25th, 2025.
The Applicant is seeking approval for two apartment buildings with a total of three-hundred and fifty-four (354) dwelling units and three-hundred and fifty-seven (357) parking spaces. Building A proposes 8-storeys with one hundred and eighty (180) dwelling units. Building B proposes stepping at the rear of the building, ranging in height from 6-storeys to 8-storeys with one hundred and seventy-four (174) dwelling units. The proposal also includes one hundred and ten long-term bicycle parking spaces, twenty-eight (28) short-term bicycle parking spaces, an underground parking garage and indoor and outdoor amenity area for residents. The City’s Zoning By-law currently zones the lands Medium Density Residential with Special Provision 81 (R3-81). Special Provision 81 outlines site specific conditions pertaining to minimum yards, minimum setbacks from adjacent streets, minimum landscape buffers and accessory use and structure permissions. Apartment dwellings are currently permitted on the subject lands however to a maximum density of 99 units per hectare and to a maximum height of 20 metres. The proposed Zoning By-law Amendment requests to rezone the subject lands High Density Residential (R4) with new Special Provision 182 to address site specific matters such as reductions to the minimum parking ratios, above grade parking stall widths, rear yard setback, and frontage, and introduces a maximum building height and minimum amenity space area to be provided.

With Bill 185 receiving Royal Assent, only the registered owner of the land to which the by-law would apply, specified persons, and public bodies as defined in the Planning Act may appeal a decision of the municipality or by-law to the Ontario Land Tribunal.
If a specified person or public body would otherwise have an ability to appeal the decision of Council of the City of St. Catharines to the Ontario Land Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to Council of the City of St Catharines before the by-law is passed, the specified person or public body is not entitled to appeal the decision.
If a specified person or public body does not make oral submissions at a public meeting, or make written submissions to Council of the City of St. Catharines before the by-law is passed, the specified person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.
