
Proposal
The Planning and Building Services Department received applications for Official Plan and Zoning By-law Amendments for 40A Ellis Avenue and adjacent lands (former railway and City-owned lands). The Applications were declared complete as of November 6, 2025, pursuant to sections 22 (6.1) and 34 (10.4) of the Planning Act.
The applicant is seeking to amend the City’s Official Plan and Zoning By-law to facilitate the development of three residential apartment buildings containing a combined total of 506 residential units. The proposal includes two 13-storey, 150-unit buildings, and one 18-storey, 206-unit building.
The City’s Official Plan designates the subject land Natural Areas, Parkland & Open Space, and Medium Density Residential. The Applicant has requested an Official Plan Amendment to redesignate the entirety of the subject lands to High Density Residential.
The Zoning By-law zones the subject land Medium Density Residential (R3), Conservation / Natural Heritage (G1) and Minor Green Space (G2). There is a Holding Provision (H1) over a portion of the lands. The Applicant has requested to rezone the entirety of the subject lands to High Density Residential (R4) with a Special Provision to permit reductions to minimum parking ratio, minimum landscape buffers, and minimum rear yard setback for Building B. The H1 holding provision will remain on the lands.

Only the registered owner of the land to which the by-law would apply, the applicant, the Minister, specified persons, and public bodies as defined in the Planning Act may appeal a decision of the municipality or by-law to the Ontario Land Tribunal.
If a person or public body would otherwise have an ability to appeal the decision of Council of the City of St. Catharines to the Ontario Land Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to Council of the City of St Catharines before the by-law is passed, the person or public body is not entitled to appeal the decision.
If a person or public body does not make oral submissions at a public meeting, or make written submissions to Council of the City of St. Catharines before the by-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.
