
The Planning and Building Services Department have received an application for Official Plan and Zoning By-law Amendment for lands located at 10 Phelps St. The application was deemed complete on Sept. 24, pursuant to Sections 22 (6.1) and 34 (10.4) of the Planning Act.
The Applicant is seeking approvals for the proposed construction of a private road development consisting of three blocks of stacked townhouses (apartment buildings) with a total of 27 units. The development is proposed to be serviced by 30 vehicle parking spaces.
The City’s Official Plan designates the subject lands Low Density Residential. The Applicant has requested to redesignate the subject lands to Medium Density Residential. The Medium Density Residential designation will permit the proposed stacked townhouse use and an increase in density.
The City’s Zoning By-law No. 2013-283 currently zones the subject lands Low Density Residential – Traditional Neighbourhood (R2). The Applicant has requested to rezone the subject lands to Medium Density Residential with a Special Provision (R3-190). The R3 zoning will permit additional uses and density, and new Special Provision 190 requests to reduce the minimum lot frontage, front yard setback, rear yard setback, vehicle parking spaces and a minimum landscape buffer.

Only the registered owner of the land to which the by-law would apply, the applicant, the Minister, specified persons, and public bodies as defined in the Planning Act may appeal a decision of the municipality or by-law to the Ontario Land Tribunal.
If a person or public body would otherwise have an ability to appeal the decision of Council of the City of St. Catharines to the Ontario Land Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to Council of the City of St Catharines before the by-law is passed, the person or public body is not entitled to appeal the decision.
If a person or public body does not make oral submissions at a public meeting, or make written submissions to Council of the City of St. Catharines before the by-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.
