
The Planning and Building Services Department received Official Plan and Zoning By-law Amendment applications for lands located at 1 Park Avenue. The applications were deemed complete on October 10, 2024, pursuant to sections 22 (6.1) and 34 (10.4) of the Planning Act.
The Official Plan and Zoning By-law Amendment applications request to permit a 9-unit 2 storey residential townhouse development. Four townhouse units will front onto Park Avenue and five townhouse units will access Park Avenue from a private driveway.
The Official Plan Amendment proposes to redesignate the lands from Parkland and Open Space to Neighbourhood Residential on the General Land Use Plan (Schedule D1) and to Low Density Residential (20 to 32 units per hectare) on the East Planning District (Schedule E9) to permit the proposed residential townhouse development.
The northern part of the lands is zoned Major Green Space (G3) while the southern part is zoned Major Green Space with a Holding Provision (G3-H1). The Zoning By-law Amendment requests to rezone the lands to Low Density Residential – Traditional Neighbourhood with a new Special Provision (R2-180). The Special Provision requests to permit an increased maximum number of attached dwelling units, a reduced minimum density per hectare and reduced minimum interior side yard and rear yard setbacks.

Only the registered owner of the land to which the by-law would apply, the applicant, the Minister, specified persons, and public bodies as defined in the Planning Act may appeal a decision of the municipality or by-law to the Ontario Land Tribunal.
If a person or public body would otherwise have an ability to appeal the decision of the Council of the City of St. Catharines to the Ontario Land Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to Council of the City of St. Catharines before the proposed amendments are adopted, the person or public body is not entitled to appeal the decision.
If a person or public body does not make oral submissions at a public meeting or make written submissions to the Council of the City of St Catharines before the by-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal, unless, in the opinion of the Tribunal, there are reasonable grounds to do so.
