Public Hearing Notice - 39 & 41 Thomas Street

An application for consent has been received from Cidaliza Paiva-Walz for the property of 39 Thomas Street and an application for consent has been received from Jacob Newman for the property of 41 Thomas Street and will be heard by the Committee of Adjustment for the City of St. Catharines on October 14, 2026.

Consent Application Details (B-21/26SC)

Application B-21/26SC is made for consent to establish an easement, in perpetuity, over 33.3m² of land (Parts 3 & 5 on the submitted sketch) for the benefit of the northerly abutting lot known as 41 Thomas Street (Parts 1 & 2) for vehicular and pedestrian access purposes. A 412.3 m² remnant parcel (Parts 3, 4, 5 & 6) with the existing two storey dwelling will be retained. Together with application B-22/26SC, the applications would result in establishing a mutual driveway between the properties.

Consent Application Details (B-22/26SC)

Application B-22/26SC is made for consent to establish an easement, in perpetuity, over 33.4 m² of land (Part 2 on the submitted sketch) for the benefit of the southerly abutting lot known as 39 Thomas Street (Parts 3, 4, 5, & 6) for vehicular and pedestrian access purposes. A 467.4 m2 remnant parcel (Parts 1 & 2) with the existing 2-1/2 storey dwelling will be retained. Together with application B-21/26SC, the applications would result in establishing a mutual driveway between the properties.

Please submit any comments in writing to the Secretary Treasurer by 12 p.m. on October 9, 2026, or you can appear in person and make a verbal presentation to the Committee.

An appeal to the Ontario Land Tribunal (OLT) may be dismissed if no written or verbal submissions were made at the hearing before the Committee gives or refuses to give approval to an application. Pursuant to the More Homes Built Faster Act, Appeals may be submitted by the Applicant, the Minister or a specified person or public body that has an interest in the matter.

Please note that all Committee of Adjustment Hearings will be held in-person at City Hall on the 3rd floor in Council Chambers. City Hall is located at 50 Church Street, St. Catharines, Ontario (Please use the James Street entrance).
