Referral

On June 22, 2026, Council referred this application back to Planning staff to discuss the outstanding issues with the applicant. Through these discussions, the applicant has submitted revisions to their originally requested draft plan of subdivision, and amendments to the Official Plan and Zoning By-law. This notice describes the applications as revised.

Proposal

The City has received applications for an Official Plan Amendment, Zoning By-law Amendment and a Draft Plan of Subdivision for lands located at 1262 and 1290 Fourth Avenue.

The Applicant is seeking approval for a subdivision of the lands which includes an extension of Pathstone Way through the site, a new public park, and three development blocks. The concept includes two blocks intended for 8-storey mixed-use buildings along Fourth Avenue, and one block intended to develop as a mix of non-residential buildings, mixed-use and/or full residential apartments, and townhouses. The exact design of this block will be determined at a later date.

The City’s Official Plan designates the subject land Mixed Use, with a special policy prohibiting residential uses on the ground-floor, and standalone residential uses. The applicant has requested an Official Plan Amendment to permit the development of ground-floor and standalone residential uses on the subject lands.

The Zoning By-law zones the subject land Business Commercial Employment with Special Provision 5 with Holding Provision 3 (E1-5-H3). The applicant requests to rezone the subject lands to Medium Density Mixed Use (M1) with a modified Special Provision 5 to permit the proposed developments. Holding Provision 3 is to remain on the lands, and the application has not requested amendments to Holding Provision 3.

Email submissions may also be made by noon the day of the public meeting and directed to clerks@stcatharines.ca. Both oral and written comments will be taken into account by City Council in making a decision on the subject matter.

Legal Notice

Only the registered owner of the land to which the by-law would apply, the applicant, the Minister, specified persons, and public bodies as defined in the Planning Act may appeal a decision of the municipality or by-law to the Ontario Land Tribunal. 

If a person or public body would otherwise have an ability to appeal the decision of Council of the City of St. Catharines to the Ontario Land Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to Council of the City of St Catharines before the by-law is passed, the person or public body is not entitled to appeal the decision.

If a person or public body does not make oral submissions at a public meeting or make written submissions to Council of the City of St. Catharines before the by-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.
