Notice Of Passing Of Interim Control By-Law 2020-28 Affecting The Establishment Of Cannabis Production Facilities In The City Of St. Catharines

TAKE NOTICE that the Council for the Corporation of the City of St. Catharines adopted Interim Control By-law No. 2020-28 on February 24, 2020 in accordance with the provisions of Section 38 of the Planning Act.

AND TAKE NOTICE that Interim Control By-law 2020-28 will be in effect for a period of one year from the date of passing, lapsing February 24, 2021 but may be extended by Council for an additional one-year period in accordance with Section 38 of the Planning Act, or repealed by Council at an earlier date.

PURPOSE AND EFFECT OF INTERIM CONTROL BY- LAW

City Council has directed that a study be undertaken to investigate the land use impacts of cannabis production facilities, including related ancillary uses, within the City’s Agriculture and Employment Zones, including impacts such as but not limited to odour, noise, light trespass and distance separations, and to make recommendations on how cannabis production facilities should be regulated.

To allow sufficient time to undertake the study, and in the interim to preclude the establishment of new cannabis production facilities in certain zones that may otherwise not be permitted as a result of study findings and recommendations, Council passed Interim Control By-law No. 2020-28.

The effect of Interim Control By-law No. 2020-28 is to place a moratorium on the establishment of new cannabis production facilities on all lands zoned under the following categories in the City’s Comprehensive Zoning By-law No. 2013-283 until the study is complete:
• Agriculture A1 zone
• Agriculture A2 zone
• Agriculture A3 zone

The above zone categories apply to a significant number of properties within the City, and as such, a key map showing the specific location of each property is not practical or feasible for this publication.
